These Terms and Conditions (“Terms”) govern access to and use of https://musicforbodyandspirit.com (the “Website”), including the purchase, download, and use of digital music offered through the Website.

Music for Body and Spirit offers original musical compositions and recordings exclusively in digital format. We do not sell physical products or provide music streaming subscriptions or recurring membership services.

The Website offers two categories of digital music:

• Paid Music: albums and individual tracks licensed exclusively for private, personal, non-commercial listening.
• Free Download Music: selected individual tracks available free of charge for commercial and non-commercial use under the specific license described in Section 8.

Different licensing conditions apply to these two categories.

By placing an order or downloading free music, users agree to the applicable provisions of these Terms, without prejudice to any mandatory rights granted by law.

Music for Body and Spirit offers original digital music albums and individual audio tracks.

Paid music products are available in the following formats, as indicated on the relevant product page:

• MP3 — 320 kbps
• WAV — 24-bit / 48 kHz

Available formats for free tracks are indicated in the Free Download section.

All products are delivered electronically. No physical goods are shipped.

Product descriptions, album information, track titles, and audio specifications are provided to help users understand the content offered.

A customer account is required to purchase paid music through the Website.

Customers do not need to register separately before beginning checkout. An account is automatically created using the email address provided during the purchasing process.

After account creation, customers receive an email containing a link to set up their password.

Customers can subsequently access their personal account through the account icon in the Website header, using their registered email address and password.

Customers are responsible for providing accurate information, maintaining the confidentiality of their login credentials, and notifying customer support if they suspect unauthorized account activity.

Customer accounts must not be shared for the purpose of distributing purchased music to third parties.

The account requirements for paid purchases do not necessarily apply to free downloads unless registration is specifically required on the relevant download page.

All prices displayed on the Website are expressed in United States Dollars (USD).

Payments are accepted through PayPal and supported credit or debit cards.

Any applicable taxes and mandatory charges will be disclosed before the customer completes the purchase.

Where the customer’s payment account uses a currency other than USD, currency conversion may be performed by the payment service provider or card issuer.

When conversion is handled by PayPal, the applicable exchange rate and any associated fees are determined according to PayPal’s terms. Relevant conversion information may be displayed during the PayPal payment process.

Music for Body and Spirit does not determine exchange rates or control currency conversion fees charged by third-party payment providers.

Customers should review the final payment details before authorizing a transaction.

An order is submitted when the customer completes checkout. The purchase contract is concluded when the order is accepted and confirmed by Music for Body and Spirit.

If payment is declined or cannot be completed, the purchased content will not become available until payment has been successfully processed.

Invoicing

Customers who require an invoice may request one within 14 days of the purchase date by contacting su*****@*******************it.com.

The request must include the necessary billing information.

Invoices are issued in accordance with applicable tax regulations. Any mandatory invoicing rights and statutory deadlines remain unaffected.

Paid music is supplied exclusively through digital download.

Following successful payment, purchased music files become available in the customer’s personal account.

Purchased files may be downloaded multiple times without predefined download limits, subject to the continued availability of the service.

Music for Body and Spirit makes reasonable efforts to maintain access to purchased digital content. Temporary interruptions may occur due to maintenance, technical issues, security requirements, or circumstances beyond our reasonable control.

Customers are encouraged to keep personal backup copies of downloaded files.

If a purchased file is unavailable, corrupted, incomplete, or cannot be downloaded, customers may contact su*****@*******************it.com or use the Website’s support form.

We will investigate the issue and, where appropriate, restore access or provide a replacement file.

Free Download tracks are made available through the dedicated section of the Website and are governed by the license described in Section 8.

All mandatory consumer rights remain unaffected.

6.1 Right of Withdrawal for Paid Digital Content

Music for Body and Spirit sells digital content that is not supplied on a tangible medium.

Under applicable European consumer protection legislation, consumers generally have a 14-day right of withdrawal from distance contracts, subject to statutory exceptions.

For paid digital content supplied without a tangible medium, the right of withdrawal may be lost once supply begins, provided that all applicable legal requirements have been satisfied.

Before the immediate supply of digital content begins, customers will be asked to:

• Give their prior express consent to the supply beginning before the end of the withdrawal period.
• Acknowledge that they will lose their right of withdrawal once the supply begins.

The consent and acknowledgement will be confirmed in the order confirmation provided to the customer on a durable medium.

Where all statutory conditions have been satisfied and supply has begun, the customer will no longer be entitled to withdraw from that purchase under the ordinary 14-day withdrawal procedure.

If these conditions have not been satisfied, the customer’s statutory withdrawal rights remain applicable.

6.2 Technical Problems and Non-Conforming Content

The loss of the right of withdrawal does not affect statutory rights relating to defective or non-conforming digital content.

If a purchased file is defective, inaccessible, incomplete, or does not conform to the contract, customers may contact our support team.

Music for Body and Spirit will assess the issue and seek to restore access, replace the affected file, or provide another remedy as required by applicable law.

Where legally required, customers may be entitled to a price reduction or termination of the contract with an appropriate refund.

6.3 Duplicate Purchases and Other Refund Requests

Customers who believe they have purchased the same product more than once or experienced a payment error should contact su*****@*******************it.com with their order details.

Requests will be reviewed individually.

Any refunds will be processed in accordance with applicable consumer protection laws and relevant payment provider procedures.

Nothing in these Terms limits or excludes mandatory consumer rights.

Purchasing music from Music for Body and Spirit grants the customer a limited, non-exclusive, non-transferable license to download and use the purchased recordings exclusively for private, personal, non-commercial listening.

This license permits customers to:

• Download purchased audio files.
• Store the files on their personal devices.
• Create reasonable backup copies for personal use.
• Listen to the music privately, including during meditation, relaxation, and other personal activities.

Purchasing digital music does not transfer ownership of the underlying compositions, sound recordings, copyrights, or other intellectual property rights.

Unless separately authorized by the relevant rights holders or permitted by applicable law, the license does not permit reproduction, redistribution, public performance, broadcasting, synchronization with audiovisual content, or commercial exploitation.

This personal-use restriction applies to paid music products and does not override the separate permissions expressly granted for Free Download tracks under Section 8.

Music for Body and Spirit offers selected original music tracks free of charge through the dedicated Free Download section of the Website.

These tracks are provided under a free, non-exclusive, non-transferable license permitting both commercial and non-commercial use, subject to the conditions below.

8.1 Permitted Uses

Free Download tracks may be used in:

• Personal and private listening.
• YouTube videos, including monetized videos.
• Podcasts and other audio productions.
• Advertisements and promotional content.
• Commercial and non-commercial films, videos, and audiovisual projects.
• Other original creative projects in which the music forms part of a larger production.

No separate license fee is charged by Music for Body and Spirit for uses expressly authorized under this section.

8.2 Attribution Requirement

Whenever a Free Download track is used in a published project, users must credit Music for Body and Spirit and include a link to the official YouTube channel.

The required attribution is:

The credit must appear in the video description, podcast notes, project credits, advertisement information, or another reasonably accessible location appropriate to the publication.

Where the publication format does not provide a conventional description or credits field, the attribution must be provided in another reasonably accessible accompanying location.

8.3 Restrictions

Users may not:

• Sell or resell Free Download tracks as standalone audio files.
• Redistribute the original recordings as standalone downloads, whether free of charge or for payment.
• Upload the recordings to music streaming or digital distribution platforms as independent musical releases.
• Include the recordings in standalone music libraries, sample packs, or downloadable audio collections intended for redistribution.
• Claim authorship or ownership of the original compositions or recordings.
• Grant third parties independent licenses to the original recordings.
• Remove or falsify identifying information concerning the original music or its author.

The license permits incorporation of the music into original creative projects but does not authorize independent redistribution of the recordings.

Publishing or distributing an original audiovisual or audio production incorporating the music is permitted under this license, provided that the recording is not offered separately as a downloadable music file.

8.4 Copyright Ownership and Scope

All copyrights and related intellectual property rights in the Free Download tracks remain with Angelo Mario Franza.

No ownership rights are transferred to the user.

This license applies exclusively to tracks expressly identified as part of the Free Download collection.

It does not extend to paid albums or tracks offered elsewhere on the Website.

The Free Download tracks are not registered with SIAE and are not published on the official YouTube channel. The YouTube channel link is provided solely for attribution and identification purposes.

The license does not guarantee that third-party platforms will never generate automated copyright notices or other content-matching alerts.

All rights not expressly granted remain reserved.

The original musical compositions and sound recordings offered through Music for Body and Spirit are protected by applicable copyright and intellectual property laws.

The compositions and recordings are the intellectual property of Angelo Mario Franza, subject to any applicable collective rights management arrangements.

Website content, including original text, artwork, graphics, product descriptions, and other protected materials, may also be protected by copyright or other intellectual property rights.

Purchasing or freely downloading music does not transfer ownership of any copyright or related rights.

The permissions granted to users depend on the applicable license:

• Paid music is subject to the personal-use license in Section 7.
• Free Download music is subject to the commercial and non-commercial use license in Section 8.

Unauthorized uses outside the applicable license may result in copyright enforcement measures in accordance with applicable law.

Except where expressly permitted by the Free Download license, separately authorized in writing, or allowed by applicable law, users may not:

• Resell, redistribute, sublicense, rent, or share music files as standalone recordings.
• Upload recordings as independent releases to streaming or music distribution platforms.
• Incorporate paid music into videos, films, podcasts, advertisements, applications, games, or other productions.
• Use paid music as background audio in public, professional, or commercial environments.
• Broadcast or publicly perform paid recordings without the necessary authorization.
• Claim authorship or ownership of the original compositions or recordings.
• Remove or alter copyright notices, credits, or identifying information.
• Make purchased recordings available to third parties through shared accounts or unauthorized distribution systems.

The commercial and non-commercial uses expressly authorized for Free Download tracks under Section 8 remain permitted, subject to attribution and the other conditions of that license.

Music for Body and Spirit makes reasonable efforts to maintain the functionality, security, and accessibility of the Website.

However, uninterrupted or error-free operation cannot be guaranteed.

The Website may occasionally be unavailable due to maintenance, software updates, technical failures, or events beyond our reasonable control.

Customers are responsible for using compatible devices, software, and internet connections to access their accounts and download music files.

Music for Body and Spirit is not responsible for problems caused exclusively by incompatible third-party software, unsupported devices, or failures in the user’s internet connection, except where applicable law provides otherwise.

Nothing in this section limits statutory rights relating to the conformity, accessibility, or functionality of purchased digital content.

To the extent permitted by applicable law, Music for Body and Spirit shall not be liable for losses resulting solely from circumstances beyond its reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence where applicable, or mandatory consumer protection obligations.

The Website and its digital products are provided in accordance with their descriptions, contractual commitments, and applicable statutory guarantees.

Music for Body and Spirit does not guarantee that listening to its music will produce specific physical, psychological, therapeutic, or medical results.

Descriptions referring to meditation, relaxation, frequencies, or spiritual well-being describe the artistic character, intended listening experience, or traditional associations of the music. They do not constitute medical advice or guaranteed health outcomes.

Music for Body and Spirit processes personal data in accordance with applicable data protection laws, including the European Union General Data Protection Regulation (GDPR), where applicable.

Personal information may be processed for account creation, order management, payment processing, digital content delivery, customer support, and compliance with legal obligations.

Music for Body and Spirit may update these Terms to reflect changes in legal requirements, business operations, payment methods, technical functionality, or services offered.

Unless required by law or otherwise expressly agreed, changes will not retroactively alter the contractual conditions applicable to purchases already completed or uses already authorized under an earlier applicable license.

These Terms are governed by Italian law, without prejudice to mandatory consumer protection provisions that may apply in the customer’s country of habitual residence.

Any dispute arising from a purchase or the use of the Website shall be subject to the jurisdiction determined by applicable law.
